FileEaters Privacy Policy

Notice at Collection: This Privacy Policy serves as our Notice at Collection under the California Consumer Privacy Act. It describes the categories of personal information we collect, the purposes for which that information is used, and whether we sell or share that information (which we do not). For more details, please see Section 10 (Privacy Rights – United States) below.
FileEaters Corp. (“FileEaters”, “we”, “us”, or “our”) operates the FileEaters macOS application, website, and related services (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the Services.
By using FileEaters, you acknowledge that your information will be handled as described in this Privacy Policy.
1. Information We Collect
We collect only the information necessary to operate the Services.
Audio and media files
Third-party cloud storage integrations
At the user’s request, FileEaters may integrate with third-party cloud storage services to allow users to select audio files for processing or to save processed outputs. FileEaters accesses only files and folders explicitly selected by the user and does not scan, index, or access other content stored in the user’s cloud storage account.
FileEaters processes audio and media files that you voluntarily upload, analyse, or otherwise submit through the App.
These files remain your property.
We do not claim ownership or intellectual property rights in your content.
Files are processed solely to provide requested functionality such as analysis, stem identification, labelling, or watermarking.
User-submitted audio and media files are not used to train artificial-intelligence or machine-learning models and are not incorporated into datasets, derivative works, or content generation systems.
Processing may occur locally on your device or temporarily on secure servers operated by FileEaters or its service providers, depending on your configuration and feature usage.
Account and contact information
If you create an account or use paid features, we may collect your name, email address, and subscription or billing status.
Payment information
Payments are processed by third-party payment processors, including Stripe. FileEaters does not store full payment card details. Payment information is handled directly by Stripe in accordance with its own privacy policy.
Technical and usage information
We may collect limited technical information necessary to operate and improve the Services, including app version, operating system version, device architecture, and diagnostic data such as crash reports and error logs. This information does not include the content of your audio files.
We collect personal information only from the following sources:
directly from users when they use the Services or communicate with us, automatically through the operation of the Services (such as technical and diagnostic data) and from service providers acting on our behalf, such as payment processors. We do not obtain personal information from data brokers, advertising networks, or third-party marketing partners.
2. How We Use Information
We use personal information for the following purposes:
- to provide, operate, and maintain the Services
- to perform requested audio analysis and related processing
- to improve accuracy, performance, and reliability
- to diagnose and resolve technical issues
- to comply with legal and regulatory obligations
- to communicate with you about product updates, new features, optional upgrades, and changes to the Services, including features that may be offered for an additional fee. You may opt out of receiving non-essential product communications at any time by following the unsubscribe instructions included in such messages.
For users located in the European Economic Area or the United Kingdom, such communications are sent based on our legitimate interests in informing existing users about the Services, or with consent where required by law.
3. Legal Bases for Processing (European Economic Area and United Kingdom)
For users located in the European Economic Area or the United Kingdom, FileEaters processes personal data on the following legal bases, as applicable:
Performance of a contract
Processing is necessary to provide the Services requested by the user, including account management, audio analysis, and related functionality.
Legitimate interests
We process certain limited personal data where necessary for our legitimate interests in operating, securing, and improving the Services. These legitimate interests include:
- maintaining the functionality, stability, and security of the Services
- preventing fraud, misuse, and unauthorised access
- debugging, error detection, and performance optimisation
- providing customer support and responding to user enquiries
When processing data on the basis of legitimate interests, we have considered the potential impact on users’ rights and freedoms and determined that such processing is proportionate, limited in scope, and does not override users’ fundamental rights. Users may object to this processing as described in the “Privacy Rights – Europe and UK” section.
Legal obligation
Processing is necessary to comply with applicable legal, accounting, or regulatory obligations.
Consent
Where required by law, we process personal data based on the user’s consent. Users may withdraw consent at any time, without affecting the lawfulness of processing carried out prior to withdrawal.
4. Data Retention
We retain personal information only for as long as necessary for the purposes described in this Policy.
Audio and media files are retained only for the duration required to perform the requested processing and are deleted automatically thereafter unless you explicitly choose to store them.
Account information is retained while your account remains active and thereafter as required for legal, billing, or audit purposes.
Technical and diagnostic data is typically retained for 60–90 days before being anonymized or deleted, depending on legal requirements and operational needs.
5. Data Sharing and Disclosure
We do not “sell” or “share” personal information as those terms are defined under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including for cross-context behavioural advertising.
We may disclose limited personal information only:
- to service providers who perform services on our behalf under contractual confidentiality and data-protection obligations
- to comply with applicable law, regulation, subpoena, or legal process
- to protect the rights, property, or safety of FileEaters, our users, or others
Our service providers may include cloud storage providers (such as Google Drive and Dropbox) and payment processors (such as Stripe), which process data solely to provide their services to FileEaters under contractual data-protection obligations. A list of our current third-party sub-processors (e.g., cloud hosting or payment providers) is available upon request by emailing support@fileeaters.com.
In the event that FileEaters is involved in a merger, acquisition, financing, reorganisation, bankruptcy, or sale of all or a portion of its business or assets, personal information may be disclosed or transferred as part of that transaction. Any such transfer will be subject to appropriate confidentiality and data-protection safeguards, and personal information will remain subject to this Privacy Policy or a substantially similar policy.
6. International Data Transfers
Your information may be processed in countries other than your country of residence. Where required by law, we implement appropriate safeguards, such as standard contractual clauses or equivalent mechanisms, to protect personal data transferred internationally.
7. Cookies and Tracking Technologies
FileEaters uses only strictly necessary cookies and similar technologies required for the operation and security of our website and Services.
We do not use third-party advertising cookies, behavioural tracking technologies, cross-site tracking pixels, or analytics tools that track users across websites or applications. We do not engage in cross-context behavioural advertising.
If we introduce additional cookies or tracking technologies in the future that are not strictly necessary, we will update this Privacy Policy and, where required by law, request user consent before deploying them.
8. Security
We implement reasonable technical and organisational safeguards designed to protect personal information, including encrypted data transmission where appropriate, access controls, and secure infrastructure.
No method of transmission or storage is completely secure. We cannot guarantee absolute security, but we continually review and improve our safeguards.
9. Children’s Privacy
The Services are not intended for children under 13 years of age. We do not knowingly collect personal information from children. If we become aware that such information has been collected, we will delete it promptly.
10. Privacy Rights – United States
General US rights
Depending on your state of residence, you may have the right to access, correct, delete, or obtain a copy of the personal information we hold about you, and to object to or restrict certain processing.
California residents
If you are a California resident, you have rights under the CCPA and CPRA, including the right to:
- know the categories of personal information collected and the purposes of collection
- request access to or deletion of personal information
- request correction of inaccurate personal information
- limit the use of sensitive personal information, where applicable
- opt out of the sale or sharing of personal information (note: FileEaters does not sell or share personal information)
We do not knowingly collect sensitive personal information as defined by the CPRA, except where such information may be incidentally contained within user-submitted audio files processed solely at the user’s direction. We only process Sensitive Personal Information (as defined by CPRA) to perform the services reasonably expected by an average consumer. We do not use SPI to infer characteristics about you.
Other US state residents
Residents of Virginia, Colorado, Connecticut, and Utah may have similar rights under applicable state laws. These rights may be exercised using the same contact methods described below.
Users may exercise applicable privacy rights by contacting us at support@fileeaters.com with sufficient information to identify the request.
We will take reasonable steps to verify the identity of the requester before responding. Verification may require confirming access to the relevant email account or account credentials.
For residents of California, we will respond to verifiable consumer requests within 45 days of receipt, as required by the California Consumer Privacy Act and California Privacy Rights Act. Where reasonably necessary, we may extend this response period once by an additional 45 days, in which case we will notify you of the extension and the reason for it.
For residents of other US states with applicable privacy laws, and for users located in the European Economic Area or the United Kingdom, we will respond within the timeframes required by applicable law.
If we deny a request, we will explain the basis for the denial where required by law.
If you are a resident of a US state that provides a right to appeal a privacy rights decision and we deny your request in whole or in part, you may appeal our decision by replying to our response email or contacting us at support@fileeaters.com. We will review and respond to appeals within the timeframe required by applicable law.
11. Privacy Rights – Europe and UK
If you are located in the European Economic Area or the United Kingdom, you have the right to:
- access your personal data
- request correction or erasure
- object to or restrict processing
- request data portability
- withdraw consent where processing is based on consent
You also have the right to lodge a complaint with your local data-protection authority.
12. Data Breach Notification
In the event of a personal data breach that is likely to result in a risk to the rights and freedoms of individuals, FileEaters will notify affected users and, where required, relevant supervisory or regulatory authorities without undue delay and in accordance with applicable law.
For users located in the European Economic Area or the United Kingdom, notification will be made in compliance with GDPR and UK GDPR requirements, including notification to the relevant supervisory authority within 72 hours where applicable.
For users located in the United States, notification will be provided in accordance with applicable federal and state data breach notification laws.
Notifications, where required, will describe the nature of the breach, the categories of information affected, and the steps we are taking to mitigate potential harm.
13. Controller/processor clarification
In most cases, FileEaters acts as a data controller with respect to personal information processed through the Services. In limited circumstances, such as where FileEaters processes content solely on documented instructions from a business customer, FileEaters may act as a data processor or service provider. In such cases, processing is governed by the applicable customer agreement rather than this Privacy Policy.
14. Changes to This Policy
We may update this Privacy Policy from time to time. The “Last updated” date indicates when the Policy was most recently revised. Material changes will be communicated where required by law.
